How Builders Can Defend Construction Dust Allegations During GRAP Restrictions?

As a builder/developer in Delhi NCR you may find yourself being investigated for violating the GRAP rules. Paying environmental compensation, building closures and monetary losses.

You have a project going on in Noida. You are finishing up on the electrics in the building and are abiding by GRAP stage 3. A group comes to inspect after receiving complaints from your neighbours about construction dust. You tell them you are not excavating/demolishing.

What can you do if you feel you have been accused of Construction Dust wrongfully?

Its all about what GRAP stage your working under and what you are accused of violating. And having evidence to prove your side.

If there is construction dust present at your site you are not automatically guilty. Having machinery to reduce dust doesn't mean you can do activities that are against the current GRAP rules.

Why GRAP Construction Dust Allegations Matter in 2026

Air quality issues in Delhi NCR have been a constant issue in times of bad weather conditions. Excavation and construction activity may lead to dust from the construction sites. This can occur while carrying out excavation, demolition, movement of material or if the material is not properly disposed off.

GRAP for the National Capital Region has been set up by the Commission for Air Quality Management.

GRAP Schedule for Construction Sites and Monitoring was notified by CAQM on 29th September 2026.

What does this mean for your construction project?

If a construction site is not maintaining adequate measures to prevent dust pollution. It could be charged with carrying out unauthorized construction during GRAP period or not adhering to registration formalities.

Construction can get delayed which will impact you as a contractor in terms of receiving payments. Delivery of projects can also be affected leading to more interest charges. Or may even lead to issues with home buyers.

NGT Lawyers can help you analyse the allegations made against you and steps you can take.

Quick Facts About GRAP Construction Dust Rules

GRAP has been divided into 4 levels where more stringent steps will be taken to control pollution.
Level 1 applicable construction dust control directions shall be followed.
Level 3 certain dust producing construction and demolition operations shall not be allowed.
Certain operations which produce less dust can continue as per applicable directions.
Construction sites with a plot area greater than or equal to 500 sq. meters should meet the requirement on the web portal set by CAQM.
Environment (Construction and Demolition) Waste Management Rules, 2025 will come into effect from 1st April 2026.
If any project has been given individual closure order they have to apply for authorisation to restart work.

What Are GRAP Construction Dust Allegations?

A GRAP Construction dust allegation is when construction activity has violated a rule pertaining to air pollution rules, dust restriction directions or any other direction.

Allegations can include exposed construction material, dust emitting, dumping of construction material and vehicles moving on site or construction taking place when not allowed.

These complaints can come from residents, inspectors, city officials or pollution control dpartments.

All allegations must be reviewed with what law actually applies.

An example would be if you have sprinklers on at your job site and you are doing work that is prohibited under stage 3. You may be in violation of construction dust rules.

There could be an allegation filed against a job site for electrical work inside which may need to be further evaluated before it's deemed a construction dust violation.

BK Singh can help review the findings of an inspection and determine what laws are being violated and what steps you need to take.

What Legal Framework Applies to Construction Dust Complaints?

Dust control acts under many Acts and Rules in Delhi NCR region.

Commission for Air Quality Management Act, 2021

As mentioned above CAQM is allowed to issue Directions under this act.

Government departments/ Pollution Control Board or Local Authority will enforce it depending on which act it has been issued under.

Environment (Protection) Act, 1986

It gives certain powers to enforce and take action on environmental related issues.

Depending upon what rule or act has been violated by you various directions and penalties may be applied.

Construction and Demolition Waste Rules, 2025

This will come into force on 1st April 2026 and deals with rules for C&D Waste which will include duties regarding its collection, segregation, processing and disposal.

Some bigger projects will have more duties imposed on them. You would need to check the criteria for your project and not assume that all projects will have the same.

National Green Tribunal Act, 2010

The NGT deals with cases where there is a substantial question related to environment and Acts mentioned under Schedule I of the NGT Act.

There are provisions under section 14, 15 and 16 which allow for certain things.

Not all notices or penalty levied by CAQM or Municipality can be challenged in NGT.

NGT Lawyers can guide you as to what body has issued the notice and which forum can you approach.

Which Construction Activities Are Restricted Under GRAP?

It will depend upon what stage of GRAP has been issued.

Stage 1 & 2

All construction sites will have to abide by the dust control norms as laid out above. This will include storage, debris, transportation and any form of emissions from the site.

Even if construction work is allowed they must still follow these rules.

Stage 3

Certain activities that produce dust will be banned under stage 3. Such as excavation, piling, demolition, masonry work, major welding and others mentioned.

Some lower polluting work can continue subject to some conditions. Certain projects of public importance can also be continued subject to what schedule is issued.

Stage 4

Additional rules will come into effect at stage 4. Including certain work relating to public utilities that may have been allowed under stage 3.

Important Note

We at NGT Lawyers advise looking at the specific CAQM directions issued on the day of inspection and any order that may be passed on your specific project.

How Can Builders Defend GRAP Construction Dust Allegations?

It has to be backed by some sort of proof and valid reasoning on why you think the GRAP restriction was not applicable.

1

Know What Is Being Accused Of

What does the inspection report state?

If it was regarding digging in soil, dust flying out from the site or movement of debris or if you weren't maintaining your sprinkler system.

Simply stating that there was construction going on may not suffice for the specific violation that has been committed.

2

Make Sure That The Stage Was Active

Make sure what restrictions were active on that day.

Just because a GRAP schedule exists does not mean that all stages are enforced at all times. There are orders which specify the GRAP restrictions that are enforced at a given time.

3

Review The Inspection

Go through the photos and findings that the inspector noted down on his sheet.

There are valid reasons why an inspection report can be contested. If you believe that the report did not accurately show what was being done on site or any other discrepancy that may have occurred.

Simply stating you disagree with the report will not help.

4

Prove That You Were In Compliance

Pictures of sprinkling water, material being covered, keeping your machinery clean and having receipts that show proper disposal of your debris can prove that you were complying with the regulations.

BK Singh Advocate and NGT Lawyers can help you with reviewing documents and drafting a representation that is legally sound.

If you did violate the restrictions then you can show steps you have taken to rectify your situation and proof of compliance. This does not exempt you from liability.
